O ministro Alexandre de Moraes divulgou a íntegra de seu voto no julgamento do Recurso Ordinário em Habeas Corpus (RHC) 170559, em que a Primeira Turma do Supremo Tribunal Federal (STF) decidiu que o Tribunal do Júri pode realizar nova deliberação em processo-crime julgado de forma contrária às provas. A decisão foi tomada por maioria de votos na sessão de 10/3, quando foi discutida a possibilidade de o Ministério Público recorrer de julgamento em que o Júri absolve o réu, mesmo após admitir a existência de materialidade e de indícios de autoria ou participação no delito. O ministro Alexandre de Moraes divergiu do relator, ministro Marco Aurélio, e seu voto foi seguido pelos demais ministros.
Repercussão geral
A matéria discutida no RHC julgado pela Turma será analisada pelo Pleno do STF no Recurso Extraordinário com Agravo (ARE) 1225185, com repercussão geral reconhecida (Tema 1087). No recurso, se discutese um tribunal de segunda instância pode determinar a realização de novo júri, caso a absolvição do réu tenha ocorrido em suposta contrariedade à prova dos autos.
