O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), extinguiu o Mandado de Segurança (MS) 37097, em que havia concedido liminar para suspender a eficácia do decreto de nomeação do delegado Alexandre Ramagem Rodrigues para o cargo de diretor-geral da Polícia Federal, no último dia 29. De acordo com informações prestadas pela Advocacia-Geral da União (AGU), após ser notificado da decisão, o presidente da República, Jair Bolsonaro, tornou sem efeito a nomeação e, em 4/5, nomeou para o cargo o delegado Rolando Alexandre de Souza.
Na decisão, o ministro Alexandre de Moraes observa que o objeto da ação estava restrito ao exame de legalidade do decreto presidencial de nomeação de Ramagem. “Portanto, opresente mandado de segurança está prejudicado em virtude da edição de novo decreto presidencial tornando sem efeito a nomeação impugnada, devendo ser extinto por perda superveniente do objeto diante da insubsistência do ato coator, conforme pacífico entendimento dessa Suprema Corte”, afirmou. Segundo o relator, nessas hipóteses, não há possibilidade do surgimento de qualquer benefício prático na continuação do processo.
